Privacy Notice to California Residents

This Privacy Notice to California Residents (this “Notice”) supplements the information contained in our general Privacy Policy and applies solely to individuals who reside in the State of California (“consumers” or “you”). We adopt this Notice to comply with the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act (together, the “CCPA”), and other California privacy laws. Any terms defined in the CCPA have the same meaning when used in this Notice.

Who This Notice Applies To
This Notice applies to Hybridge” and  “Hybridge Dental Implants” and refers to professional dental services separately provided by Elmwood Dental Group – Implant and Restoration, P.C., Buffalo Dental Smile Design P.C., Syracuse Dental Smile Design P.C., and their licensed dentists and its affiliated dental practice locations in Buffalo, Rochester, and Syracuse, New York (collectively, “we,” “us,” “our,” or the “Service”). PLEASE NOTE, IF YOU’RE VISITING A “TRUSTED HYBRIDGE PARTNER” YOU SHOULD TAKE EXTRA CARE TO REVIEW THEIR PRIVACY POLICIES AS THEY ARE NOT OWNED OR OPERATED BY HYBRIDGE, LLC OR ANY OF ITS SISTER ENTITIES, SUBSIDIARIES OR AFFILIATES. YOU CAN DO THIS BY CALLING THEM DIRECTLY USING THE PHONE NUMBER ON THE TRUSTED HYBRIDGE PARTNERS PAGE OR BY VISITING THEIR RESPECTIVE SITE FOR MORE INFORMATION.

Scope and Health Information Exclusion
‍Some information we maintain about patients is protected health information governed by the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”) and the California Confidentiality of Medical Information Act (“CMIA”). The CCPA does not apply to that medical information, and this Notice does not cover it. This Notice covers Personal Information we collect outside of those frameworks. For example, information gathered through our website, marketing and appointment forms, analytics tools, and advertising activities.

1. Information We Collect
‍The Service collects information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or device (“Personal Information”). In particular, within the last twelve (12) months, the Service has collected the following categories of Personal Information:

Personal Information does not include:

• Publicly available information from government records.
• Deidentified or aggregated consumer information.
• Information excluded from the CCPA’s scope, such as: (i) health or medical information covered by HIPAA and the CMIA, or clinical trial data; and (ii) personal information covered by certain sector-specific privacy laws, including the Fair Credit Reporting Act (FCRA), the Gramm-Leach-Bliley Act (GLBA) or California Financial Information Privacy Act (FIPA), and the Driver’s Privacy Protection Act of 1994 (DPPA).

Sources of Personal Information
‍We obtain the categories of Personal Information listed above from the following categories of sources:

• Directly from you. For example, information you provide through the Service, appointment and patient forms, and correspondence by mail, email, text message, or phone.
• Indirectly from you. For example, by observing your actions and interactions on the Service through cookies, pixels, and analytics technologies.
• From third parties. For example, advertising networks and analytics providers, and any social networking services you choose to integrate with the Service.

2. Sensitive Personal Information
‍Under the CCPA, we do collect sensitive personal information. To the extent any health-related information you submit through our website falls outside HIPAA and the CMIA, we use it only to respond to your inquiry and to schedule care. Purposes that do not trigger a consumer’s right to limit the use of sensitive personal information under the CCPA. If you choose to upload a photograph to our Smile Generator, we treat that photograph, the simulated image generated from it, and any biometric information derived from it as sensitive personal information. We use them solely to provide the simulation you requested and to share the result with your local Hybridge provider. We do not use them for cross-context behavioral advertising, and we do not sell or share them.

3. Use of Personal Information
‍We may use or disclose the Personal Information we collect for one or more of the following business purposes:

• To fulfill or meet the reason you provided the information. For example, to respond to an inquiry, provide a price quote, or schedule an appointment.
• To provide, support, personalize, and develop our Service, products, and services.
• To create, maintain, customize, and secure any account or records we hold about you.
• To process your requests and prevent fraudulent activity.
• To provide you with support and to respond to your inquiries, including to investigate and address your concerns and monitor and improve our responses.
• To personalize your experience and to deliver content and service offerings relevant to your interests, including targeted offers and advertising through the Service, third-party sites, and via email or text message (with your consent, where required by law).
• For testing, research, analysis, and product development, including to develop and improve the Service.
• To communicate with you about new features, products, or services.
• To help maintain the safety, security, and integrity of the Service, our databases and technology assets, and our business.
• To respond to law enforcement requests and as required by applicable law, court order, or governmental regulations.
• To evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets.
• As described to you when collecting your Personal Information, or as otherwise permitted by the CCPA.

We will not collect additional categories of Personal Information, or use the Personal Information we collected for materially different, unrelated, or incompatible purposes, without providing you notice.

4. Disclosure, “Selling,” and “Sharing” of Personal Information
‍We disclose Personal Information to service providers and contractors for business purposes. The CCPA defines “selling” and “sharing” broadly. Because we use third-party advertising and analytics technologies (such as the Meta Pixel and Google Analytics) that may transmit online identifiers and internet activity to those companies for analytics and cross-context behavioral advertising, these activities may be considered “sharing” or “selling” of Personal Information under the CCPA. You have the right to opt out, as described in Section 6.In the preceding twelve (12) months, we may have “sold” or “shared” the following categories of Personal Information to advertising networks and analytics providers:

• Category A: Identifiers
• Category F: Internet or other similar network activity
• Category G: Geolocation data

We do not knowingly sell or share the Personal Information of consumers under 16 years of age.

5. Disclosures of Personal Information for a Business Purpose
‍In the preceding twelve (12) months, we have disclosed the following categories of Personal Information for a business purpose:

• Category A: Identifiers
• Category B: California Customer Records categories
• Category D: Commercial information
• Category F: Internet or other similar network activity
• Category G: Geolocation data
• Category E: Biometric information
• Category H: Sensory data

We disclose Personal Information for a business purpose to the following categories of third parties:

• Service providers and contractors
• Parents, subsidiaries, and affiliates
• Content delivery network and website security providers
• Smile simulation and AI imaging providers

6. Your Rights and Choices
‍The CCPA provides California residents with specific rights regarding their Personal Information. This section describes those rights and how to exercise them. You have the right to:

• Know / Access. Request that we disclose the categories and specific pieces of Personal Information we have collected about you over the past twelve (12) months, the sources, our purposes, and the categories of third parties with whom we share it.
• Data Portability. Receive the specific pieces of Personal Information we collected in a readily usable format.
• Delete. Request that we delete Personal Information we collected from you, subject to certain exceptions.
• Correct. Request that we correct inaccurate Personal Information we maintain about you.
• Opt Out of Sale or Sharing. Direct us not to sell or share your Personal Information. We honor Global Privacy Control (GPC) browser signals as a valid opt-out request.
• Limit Use of Sensitive Personal Information. To the extent applicable, direct us to limit the use of any sensitive personal information to permitted purposes.
• Non-Discrimination. Not receive discriminatory treatment for exercising any of your CCPA rights.

Deletion Request Exceptions
‍We may deny a deletion request if retaining the information is necessary for us or our service providers to:

• Complete the transaction for which we collected the Personal Information, provide a good or service you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
• Detect security incidents; protect against malicious, deceptive, fraudulent, or illegal activity; or prosecute those responsible for such activities.
• Debug products to identify and repair errors that impair existing intended functionality.
• Exercise free speech or ensure another consumer’s right to exercise free speech, or exercise another right provided for by law.
• Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et seq.).
• Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest (subject to applicable ethics and privacy laws) where deletion may render the research impossible or seriously impair it, if you previously provided informed consent.
• Enable solely internal uses reasonably aligned with consumer expectations based on your relationship with us.
• Comply with a legal obligation.
• Make other internal and lawful uses of the information compatible with the context in which you provided it.

Please include at least three points of contact information so we can properly identify your information to opt-out. For example, full name, email address, and home phone number. Or full name, mailing address, and phone number. This helps ensure we can properly honor your opt-out request. We also honor GPC browser signals.

Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your Personal Information. You may also make a verifiable consumer request on behalf of your minor child. To authorize an agent, we may require proof that you provided the agent written permission to act, and we may require you to verify your own identity directly with us; a valid power of attorney may be sufficient.

You may make a verifiable consumer request for access or data portability twice within a twelve (12) month period. The request must provide sufficient information for us to reasonably verify you are the person about whom we collected Personal Information (or an authorized representative), and describe your request with enough detail for us to properly evaluate and respond to it. We cannot respond or provide Personal Information if we cannot verify your identity or authority. Making a request does not require you to create an account with us, and we will use Personal Information provided in a request only to verify the requestor’s identity or authority.

8. Response Timing and Format
‍We endeavor to respond to a verifiable consumer request within forty-five (45) days of receipt. If we require more time (up to an additional forty-five (45) days), we will inform you of the reason and extension period in writing. Any disclosures we provide will cover only the twelve (12) month period preceding receipt of the request. We do not charge a fee to process or respond to a verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded; if we determine a fee is warranted, we will explain why and provide a cost estimate before completing your request.

9. Non-DiscriminationWe will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:

• Deny you goods or services.
• Charge you different prices or rates for goods or services, including through discounts or other benefits, or by imposing penalties.
• Provide you a different level or quality of goods or services.
• Suggest that you may receive a different price, rate, level, or quality of goods or services.

We do not offer financial incentives in exchange for the retention or sale of Personal Information, and will not do so for the term this Notice is posted in its current form.

10. Other California Privacy Rights (“Shine the Light”)
‍California’s “Shine the Light” law (Cal. Civ. Code § 1798.83) permits California residents who use our Service to request certain information regarding our disclosure of Personal Information to third parties for those third parties’ direct marketing purposes. 11. Changes to This Notice
‍We reserve the right to amend this Notice at our discretion and at any time. When we make changes, we will post the updated Notice on the website and revise the effective date above. Your continued use of the Service following the posting of changes constitutes acceptance of those changes.
