CONSUMER HEALTH DATA PRIVACY NOTICE

This Consumer Health Data Privacy Notice (“Notice”) supplements the information in our Privacy Policy. It describes how Hybridge, LLC and its affiliated dental practices in Buffalo, NY (Buffalo Dental Smile Design P.C.), Rochester, NY (Elmwood Dental Group – Implant and Restoration, P.C.), and Syracuse, NY (Syracuse Dental Smile Design P.C.), (“Hybridge,” “we,” “us,” or “our”) collect, use, and disclose “consumer health data” in connection with hybridgeimplants.com and our related email, phone, and text communications and marketing activities (collectively, the “Services”), and the choices available to you.

“Consumer health data” has the meaning given under applicable state privacy laws and generally refers to personal information that is linked or reasonably linkable to a consumer and that identifies the consumer’s past, present, or future physical or mental health status. This Notice does not apply to protected health information governed by the Health Insurance Portability and Accountability Act (“HIPAA”) or the medical records held by your local Hybridge provider, which are handled under that provider’s separate privacy practices.

1. Consumer Health Data We Collect
We collect limited health-related information directly from you when you choose to submit it through our website forms or when you contact us to request information or schedule a consultation. This may include:

• The dental service or treatment you indicate interest in (for example, dental cleaning or dental implants);
• Any information you choose to share in a free-text comment field, which may include details about your dental situation or what you hope to achieve;
• A photograph of your face, if you choose to upload one to our Smile Generator tool, along with the AI-generated simulated image produced from it; and
• The fact that you used the Smile Generator, which indicates interest in dental implant or smile restoration treatment.

We do not require you to provide health-related details, and we ask that you share only what is necessary for us to respond to your request. Alongside this information, we also collect basic contact information such as your name, phone number, and email address, as described in our Privacy Policy.

2. Photographs You Upload to the Smile Generator
‍Our Smile Generator is provided by SmileGen, operated by BiteBot (“our simulation provider”). When you upload a photograph, it is transmitted to and processed by our simulation provider on our behalf to generate a simulated image of your smile. Our simulation provider acts as a business associate under a written Business Associate Agreement with us and may use your information only to provide this service. Because a facial photograph submitted in connection with an interest in dental treatment may be treated as consumer health data under some state laws, we describe it here.

To generate your simulation, our simulation provider processes your photograph and derives data from it, including facial landmarks and facial geometry used to align and render the result. Our simulation provider has stated that it does not perform facial recognition, does not create or store biometric templates for identification, and does not use patient images to train AI models without explicit consent. Only the image is transmitted to its AI image processor, without your name or contact information.

If you submit your contact information through the tool, we receive a notification that includes your photograph and your simulated image, and we share them with your local Hybridge provider so they can discuss your goals with you. We use them only for that purpose. We do not use your photograph for advertising, and we do not sell it.

Our simulation provider stores your photograph and the simulated image for 30 days from creation and then automatically deletes them, and deletes any biometric identifiers derived from your photograph within 30 days of your last interaction with that image set. The copy we receive in the notification described above is retained only as long as needed to respond to your inquiry and discuss your treatment options, and is deleted when it is no longer needed for that purpose. If you become a patient of a Hybridge provider, your images become part of your dental record and are then governed by that provider’s HIPAA Notice of Privacy Practices rather than this Notice.

You may request deletion of your photograph and simulated image at any time, from us and from our simulation provider, using the contact information in Section 5 below. Uploading a photograph is entirely optional. You can request a consultation without using this tool.

3. How We Use Consumer Health Data
‍We use the consumer health data described above to respond to your inquiry and schedule a consultation, to share your request with your local Hybridge provider so they can follow up with you, to communicate with you about the services you expressed interest in, and to provide information about our products and services. We may also use this information for internal reporting and to improve the Services. Where we monitor or record calls made to us, we do so for quality assurance and training purposes.

4. How We Disclose Consumer Health Data
‍We may disclose consumer health data to your local Hybridge provider so they can respond to your request, and to the categories of third parties described in the “How We Share Information” section of our Privacy Policy, such as service providers who help us operate the Services. We do not sell consumer health data. We may share it for cross-context behavioral advertising where appropriate.

5. Your Choices and Rights
‍Depending on your state of residence, you may have rights regarding your consumer health data, which may include the right to confirm whether we are processing your data, to access it, to request its deletion, and to withdraw consent you previously provided. Where we rely on your consent to collect or share your consumer health data, you may withdraw that consent at any time, and we will stop collecting or sharing it going forward, to the extent applicable. If you used the Smile Generator, your rights include the right to request deletion of the photograph you uploaded and the simulated image generated from it.
