‍Hybridge, LLC and its affiliated dental practices in Buffalo, NY (Buffalo Dental Smile Design P.C.), Rochester, NY (Elmwood Dental Group – Implant and Restoration, P.C.), and Syracuse, NY (Syracuse Dental Smile Design P.C.), (“Hybridge,” “we,” “us,” or “our”)  operate this website at hybridgeimplants.com (this “Site”). These Terms of Use (“Terms”) govern your access to and use of this Site. By accessing or using this Site, you agree to be bound by these Terms and by our Privacy Policy and Cookie Policy, which are incorporated by reference.

Please read these Terms carefully. If you do not agree to them, do not access or use this Site. We may update these Terms from time to time; changes are effective when posted, and your continued use of this Site after changes are posted constitutes acceptance. The “Last Updated” date above shows when these Terms were last revised, and you are responsible for reviewing them periodically.

2. Independent Providers; No Doctor-Patient Relationship
‍Each Hybridge dental implant office is independently owned and operated by a licensed dental practitioner who has completed Hybridge Full Arch Dental Implant Protocol certifications. Hybridge, LLC does not itself provide dental care and is not responsible for the care delivered by any provider.

The information on this Site is provided for general informational purposes only and is not medical or dental advice. Using this Site does not create a doctor-patient or provider-patient relationship. This Site is not a substitute for professional diagnosis or treatment, and you should always consult a qualified Hybridge provider or other healthcare professional regarding your specific situation. Do not disregard or delay seeking professional advice based on anything you read on this Site.

3. Eligibility and Permitted Use
‍This Site is intended for users who are 18 years of age or older and located in the United States. By using this Site, you represent that you meet these requirements and that your use complies with all applicable federal, state, and local laws. We make no representation that Site materials are appropriate or available for use outside the United States.

4. Prohibited Uses
‍As a condition of your use of this Site, you agree that you will not:

• Use this Site for any unlawful purpose or in violation of these Terms;
• Provide false or misleading information, or impersonate any person or entity;
• Use this Site in any way that could disable, overburden, damage, or impair it, or interfere with any other party’s use;
• Use any robot, spider, scraper, or other automated means to access, monitor, or copy Site content without our prior written consent;
• Introduce any viruses, malware, or other harmful code, or attempt to gain unauthorized access to this Site or its related systems or networks;
• Reverse engineer, decompile, or disassemble any portion of this Site;

We reserve the right, but assume no obligation, to monitor use of this Site, and to review, retain, or disclose information as necessary to comply with applicable law or protect our rights. Evidence of unlawful use may be referred to law enforcement.

5. Communications and Text Messaging
‍When you provide your phone number and opt in on one of our forms, you consent to receive calls and text messages from Hybridge and your local Hybridge provider, which may include appointment-related messages, treatment follow-ups, and, with your consent, occasional marketing messages. Message frequency varies, and message and data rates may apply. Your consent to receive these messages is not a condition of receiving care or services.

You can opt out of marketing texts at any time by replying STOP, and reply HELP for assistance. Supported carriers are not liable for delayed or undelivered messages. Your mobile opt-in information will not be shared or sold to third parties for their own marketing purposes, and all communications are handled in accordance with our Privacy Policy and applicable law.

By providing your email address, you consent to receive emails from us for informational, transactional, and marketing purposes. You can unsubscribe from marketing emails using the link in any such message or by replying with "UNSUBSCRIBE" in the subject line or beginning of the message body.

6. Intellectual Property
‍This Site and all of its content, including text, images, graphics, logos, designs, video and audio, and the selection and arrangement thereof, are owned by Hybridge or its licensors and are protected by United States copyright, trademark, and other intellectual property laws. The Hybridge name, Hybridge Dental Implants, Hybridge Full-Arch, the Hybridge Full Arch Dental Implant System, and related marks are trademarks of Hybridge. You may not copy, reproduce, republish, distribute, modify, create derivative works from, or otherwise use any Site content without our prior written permission.

7. User-Submitted Content
‍If you submit reviews, testimonials, photographs, comments, or other content to us or through this Site or our social media pages (“User Content”), you represent that you own or have the rights to that content, that it is your original creation, and that it does not violate the rights of any third party or any law. You must not submit content that is unlawful, defamatory, obscene, offensive, or that contains another person’s private or health information without their consent.

By submitting User Content, you grant Hybridge a worldwide, royalty-free, perpetual, non-exclusive license to use, reproduce, modify, publish, and display that content in connection with our business and marketing, with or without attribution. We are not obligated to use any User Content and may remove it at any time. If your submission relates to your own treatment, you acknowledge that by voluntarily sharing it, that information is no longer treated as protected health information.

8. AI-Generated Content and the Smile Generator
‍This Site offers a Smile Generator tool that uses artificial intelligence to produce a simulated image of how your smile could look. The tool is provided by SmileGen, operated by BiteBot, a third-party provider. Hybridge does not create, code, train, or control the underlying AI system.

Any image the Smile Generator produces is AI-generated content. It is a visual simulation only. It is not a photograph of you, not a clinical prediction, not a diagnosis, not a treatment plan, and not a representation or warranty of any result you will achieve. Actual treatment outcomes vary by individual and can be determined only through an in-person examination by a licensed dentist. Use of this tool does not create a doctor-patient or provider-patient relationship, and you should not make any treatment or financial decision in reliance on a generated image.

By uploading a photograph to the Smile Generator, you represent that the photograph is of you, that you are at least 18 years of age, and that you have the right to submit it. Do not upload a photograph of any other person.

Images produced by the Smile Generator may contain embedded provenance or content-credential metadata identifying them as AI-generated. You may not remove, alter, obscure, or disable that metadata, and you may not remove or obscure any visible label identifying an image as AI-generated. You may not present any image produced by this tool as an actual patient result, an actual photograph, or a clinical outcome, whether on social media or elsewhere.

The Smile Generator is provided on an as-is basis, without warranty of accuracy, availability, or fitness for any purpose, and is subject to the disclaimers and limitations of liability in Sections 10 and 11 below.

9. Links to Third-Party Websites
‍This Site may contain links to third-party websites that we do not control or maintain. We provide these links for convenience only, and their presence does not imply endorsement or association. We are not responsible for the content, products, services, or privacy practices of third-party websites, and you access them at your own risk.

10. Disclaimer of Warranties
‍THIS SITE AND ALL CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that this Site will be accurate, complete, reliable, uninterrupted, secure, or free of errors or harmful components. Any reliance you place on Site content is at your own risk, and you are responsible for maintaining your own anti-virus protection and data backups.

11. Limitation of Liability
‍TO THE FULLEST EXTENT PERMITTED BY LAW, HYBRIDGE AND ITS AFFILIATED PRACTICES, AND THEIR RESPECTIVE OWNERS, DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS, WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, REVENUE, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THIS SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits any liability that cannot be limited under applicable law.

12. Indemnification
‍You agree to indemnify, defend, and hold harmless Hybridge and its affiliated practices, and their respective owners, officers, directors, employees, and agents, from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of this Site, your User Content, your violation of these Terms, or your violation of any applicable law or the rights of any third party.

13. Governing Law and Venue
‍These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or this Site will be brought exclusively in the state or federal courts located in Monroe County, New York, and you consent to the personal jurisdiction of those courts.

14. Severability and Waiver
‍If any provision of these Terms is found invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of that right or provision.

‍We may revise these Terms from time to time. When we do, we will update the “Last Updated” date above and post the current version on this Site. Your continued use of this Site after changes are posted constitutes acceptance of the revised Terms.
